Cutback asphalt will be banned during the ozone season, May 1 to September 30, under regulations proposed and finalized by the Department of Environmental Protection, effective January 1, 2009.
In a public hearing last May, small town representatives and contractors were universally opposed to the regulation, which was originally scheduled to be effective January 1, 2008, stating alternatives will cost more and the regulations are not necessary and will be counterproductive. The agency has revised the regulation to address the comments, essentially by delaying the effective date and increasing the limit of oil distillate produced in asphalt.
